Car Ride Giveaway Contest Rules
CONTEST NAME: MR. NICE GUY "CAR RIDE GIVEAWAY"
CONTEST DATES: AUGUST 15, 2013 - OCTOBER 9, 2013
CONICELLI
AUTOPLEX (includes Conicelli Toyota/Scion of Conshohocken, Conicelli
Honda, Conicelli Nissan, Conicelli Hyundai) , 1200 RIDGE PIKE,
CONSHOHOCKEN, PA 19428
AND
CONICELLI TOYOTA/SCION OF SPRINGFIELD, 860 BALTIMORE PIKE, SPRINGFIELD, PA 19064
ALL WILL BE REFERRED TO AS THE "COMPANY"
Conicelli
Autoplex and Conicelli Toyota of Springfield, its subsidiaries and
affiliated companies, will conduct the contest substantially as
described in these rules, and by participating, each participant agrees
as follows:
DESCRIPTION OF CONTEST/PARTICIPATION
How to Enter
Test drive is required. No purchase is necessary to enter the Contest and a purchase will not improve your chances of winning.
Participants
test drive a new or pre-owned vehicle at one of the Company dealerships
during the contest period. Participant must then fill out an entry form
provided by Company.
Eligible participants must be 18 years or older.
How to Play
The
participants must take a test drive of a new or pre-owned vehicle at
(Conicelli Toyota/Scion of Conshohocken, Conicelli Toyota/Scion of
Springfield, Conicelli Honda, Conicelli Nissan or Conicelli Hyundai) and
then fill out an entry form to enter. No other form of entry is
acceptable.
Prize
The Grand Prize winner will receive a 24 month lease for one of the following new vehicles provided they qualify:
New Toyota Corolla
New Scion xD
New Honda Civic
New Hyundai Elantra
New Nissan Altima
Or $5000.00.
Grand Prize winner will be drawn on October 11, 2013.
The
"Company" will also award a weekly prize of a ipad mini to one
participant. Each weekly winner is still eligible to win the Grand
Prize. Weekly prize winner will be drawn each Monday during the contest
period using entries from the previous week.
Eligibility and Limitations
Entrants
and winner must be U.S. residents and at least 18 years old as
determined by the Company and reside in the states of Pennsylvania, New
Jersey or Delaware. The Company reserves the right to refuse to award a
prize to or on behalf of a minor or other non-eligible entrant.
Employees of the Company, the Company's advertising agency and its
employees and members of the immediate family of any such persons are
not eligible to participate and win. The term "immediate family"
includes spouses, siblings, parents, children, grandparents and
grandchildren, whether as "in-laws", or by current or past marriage(s),
remarriage(s), adoption, co-habitation or other family extension, and
any other persons residing at the same household whether or not related.
The
Company will disqualify any entry from any Participant who does not
meet these eligibility requirements and the Company will delete an entry
from any party under the age of 13, as required by the Children's
Online Privacy Protection Act.
Publicity
By
participating, all participants and winners grant the Company exclusive
permission to use their names, characters, photographs, voices and
likeness with promotion of this and other contests and waive any claims
to royalty, right or remuneration for such use.
Release
By
participating in the Contest, participants and winner waive any and all
claims of liability against the Company, its affiliates, its employees
and agents and their respective employees, for any personal loss which
may occur from the conduct of, or participation in, the Contest, or from
the use of any prize. In order to receive a prize, participants must
sign an official waiver form provided by the Company.
Taxes
Any
valuation of the prize(s) stated above is based on available
information from the Company, and the value of any prize awarded to a
winner may be reported for tax purposes as required by law. Winner(s)
must provide the Company with valid identification and a valid taxpayer
identification number or Social Security number before any prize will be
awarded. Prize is not transferable, redeemable for cash or exchangeable
for any other prize. Any person winning over $600 in prizes from the
Company will receive an IRS form 1099 at the end of the calendar year
and a copy of such form will be filed with the IRS.
Conduct and Decisions
By
participating in the Contest, participants agree to be bound by the
decisions of the Company personnel. Persons who violate any rule, gain
unfair advantage in participating in the Contest, or obtain winner
status using fraudulent or false means will be disqualified.
Unsportsmanlike, disruptive, annoying, harassing or threatening behavior
is prohibited. The Company will interpret these rules and resolve any
disputes, conflicting claims or ambiguities concerning the rules or the
Contest and the Company's decisions concerning such disputes shall be
final. If the conduct or outcome of the Contest is affected by human
error, printing errors, typographical errors, internet, electronic or
any mechanical malfunctions or failures of any kind, intentional
interference, by any participant or any third party, or any event beyond
the control of the Company, the Company reserves the right to terminate
the contest, or make such other decisions regarding the outcome as the
Company deems appropriate. All decisions pertaining to the Contest will
be made by the Company and such decisions are final. The Company may
waive any of these rules in its sole discretion.
ANY ATTEMPT BY A
PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT
OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, WEBSITE, OR
UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF
CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY
RESERVES THE RIGHT TO DISQUALIFY SUCH PARTICIPANT AND TO SEEK DAMAGES
FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
Miscellaneous
Winner(s)
must submit proof of eligibility and sign the Company's release form to
claim the prize.. Grand prize winner is required to have a credit score
of 700+ Transunion Autodriven score, verifiable income and 100/300/50
insurance liability limits, full coverage including comprehensive and
collision with $1000 or less deductible. If the Grand Prize winner does
not qualify for the vehicle they will receive $5000.00. No purchase
necessary to participate or win. A purchase does not increase your
chance of winning. Void where prohibited. Odds of winning depend upon
the number of entries received. The Company may substitute prizes, amend
rules or discontinue the contest at any time as announced on our
website at www.conicelli.com/car-ride-giveaway.htm. The Company
disclaims any responsibility to notify participants of any aspect
related to the conduct of the Contest. Written copies of these rules are
available during normal business hours at the business offices of the
Company and by mail upon written request with a stamped, self addressed
return envelope.
Compliance with Law
The conduct of
the Contest is governed by the applicable laws of the United States of
America and applicable state law, in that order of precedence, which
take precedence over any rule to the contrary herein. Company shall
follow the applicable laws for conducting contests, including notice to
the state attorney general or consumer affairs office, posting of a
prize bond, furnishing list of winners, providing specific written
information about the Contest, etc, as required by local and state law.
Each Participant submits to the personal jurisdiction of the Court of
Common Pleas of Montgomery County, Pennsylvania and the Federal District
Court of the Eastern District of Pennsylvania.
Additional Contest Rules
Each
winner must submit proof of eligibility and sign the Company's release
form to claim the prize. Any winner who does not comply with the terms
of this paragraph will forfeit the prize. The winning submission will be
chosen by Conicelli management. The winning entry will be notified via
phone and/or email and the winning participant must be present to
collect the prize. The winner will be announced on all Conicelli media
placements.
